This Sales Agreement Preliminary Information Form concerns the sale and delivery of the product(s) specified below, with their characteristics and sales price, sold by the Seller to the Buyer, and covers the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on the Protection of Consumers – Distance Contracts Regulation. By accepting this preliminary information form, the Buyer acknowledges that if they approve the order subject to this contract, they will be obligated to pay the price of the order and any additional fees such as shipping costs and taxes, and that they have been informed of this beforehand.

4 - INFORMATION ABOUT THE PRODUCT(S) SUBJECT TO THE AGREEMENT

4.1. The type, quantity, brand/model, color, number of units, sales price, and payment method of the goods/product/service are published on the Seller's website at https://www…….com.tr/. If the Seller has organized a campaign, the basic features of the relevant product can be reviewed during the campaign period, and the price and other published information are valid for the duration of the campaign.

4.2 The prices listed and advertised on the site are sales prices. Advertised prices and promises are valid until updated or changed. Prices advertised for a limited time are valid until the end of the specified period.

4.3 The sales price of the goods or services subject to this contract, including all taxes, is shown in the table below.

5- DELIVERY OF PRODUCTS

5.1. Delivery of goods will be made within the promised time after payment is received. The Seller shall deliver the goods or services within 30 (thirty) days from the date the Buyer orders the goods or services, except in cases where the fulfillment of the order becomes impossible.

5.2. If, for any reason, the Buyer fails to pay for the goods or services or the payment is cancelled in the bank records, the Seller shall be deemed released from the obligation to deliver the goods or services.

5.3. In cases of order cancellations by the Buyer after the goods have been shipped by the Seller but before delivery by the Buyer, the Buyer is responsible for the shipping costs.

5.4. In cases where the fulfillment of the order becomes impossible, the Seller shall inform the Buyer within 3 (three) days of learning of this situation and shall refund all payments received, including any delivery costs, within a maximum of 14 (fourteen) days from the date of notification.

5.6. If the product(s) are to be delivered to a person other than the Buyer, the Seller cannot be held responsible if the recipient refuses delivery.

5.7. The Buyer is obligated to inspect the product upon receipt and immediately notify the Seller of any defects found.

6.  GENERAL PROVISIONS

6.1 The Buyer declares that they have read and are aware of the essential characteristics of the product subject to sale, the sales price, the payment method, and preliminary information regarding delivery in this form, and that they have provided the necessary written confirmation.

6.2 By confirming this form in writing, the Buyer confirms that they have received accurate and complete information from the Seller regarding the address, essential characteristics of the ordered products, the price of the products including taxes, and payment and delivery information, which must be provided to the Buyer before the conclusion of distance contracts.

6.3 The Seller cannot be held responsible for the failure to deliver the ordered product to the Buyer due to any problems encountered by the shipping company during the delivery process.

6.4 The Seller is responsible for delivering the product in good condition, complete, conforming to the specifications stated in the order, and with any warranty documents and user manuals, if applicable.

6.5 If it is determined that the product cannot be supplied for a justifiable reason before the delivery date, the Seller may supply a different product of equal quality and price by informing the Buyer and obtaining their written approval.

6.6 If delivery of the Product becomes impossible, the Seller shall notify the Buyer of this before the expiry of the performance obligation arising from the contract and refund the total amount to the Buyer within 14 (fourteen) days.

6.7 If the product price is not paid for any reason or is cancelled in the bank records, the Seller shall be deemed to be relieved of its obligation to deliver the product.

6.8 If the Buyer fails to pay the product price to the Seller for any reason, the Buyer shall return the product to the Seller at their own expense within 3 days of the Seller's notification. The Seller's right to pursue the product price and all other contractual and legal rights are reserved in all circumstances.

6.9 This Preliminary Information Form provides the Buyer with information about the details of their order, and the Buyer is required to approve the distance sales contract in accordance with the Distance Contracts Regulation regarding the electronic purchase of goods or services.

8. RIGHT OF WITHDRAWAL

8.1- In distance contracts relating to the sale of goods, the Buyer may exercise the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the product to himself or to the person/entity at the address indicated, provided that he notifies the Seller, without incurring any legal or criminal liability and without giving any reason. In distance contracts relating to the provision of services, this period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has begun with the Buyer's consent before the expiration of the withdrawal period. The costs arising from the exercise of the right of withdrawal shall be borne by the Buyer. By accepting this contract, the Buyer acknowledges that he/she has been informed about the right of withdrawal.

8.2- To exercise the right of withdrawal, it is necessary to notify the Seller in writing by registered mail, fax or e-mail within the 14 (fourteen) day period and the product must not have been used within the framework of the "Products for Which the Right of Withdrawal Cannot Be Exercised" provisions stipulated in this contract. If this right is exercised,

8.2.1- The invoice for the product delivered to the third party or the Buyer (If the invoice for the product to be returned is issued to a company, it must be sent together with the return invoice issued by the company. Returns of orders invoiced to companies cannot be completed unless a RETURN INVOICE is issued.)

8.2.2- The products to be returned must be delivered complete and undamaged, including the box, packaging, and any standard accessories.

8.2.3- If this right is exercised, it is mandatory to return the original invoice and a copy of the shipping delivery receipt showing that the product delivered to the third party or the Buyer has been sent back to the Seller. The product price will be refunded to the Buyer within 14 days following the receipt of these documents.

8.2.4- If there is a decrease in the value of the goods or if return becomes impossible due to a reason caused by the Buyer's fault, the Buyer is obliged to compensate the Seller for the damages in proportion to their fault. However, the Buyer is not responsible for changes and deteriorations caused by the proper use of the goods or product within the withdrawal period.

9.PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

a) Contracts for goods or services whose price varies depending on fluctuations in financial markets and is beyond the control of the Seller or Supplier.

b) Contracts for goods prepared according to the Buyer's requests or personal needs.

c) Contracts for the delivery of perishable goods or goods whose expiration date may pass.

d) Contracts for the delivery of goods from which the protective elements such as packaging, tape, seal, or wrapping have been opened after delivery, and whose return is not suitable for health and hygiene reasons.

e) Contracts for goods that are mixed with other products after delivery and whose separation is not possible due to their nature.

f) Contracts for books, digital content, computer consumables, data recording and data storage devices presented in a physical medium, if the protective elements such as packaging, tape, seal, or wrapping have been opened after delivery.

f) Contracts for the delivery of periodicals such as newspapers and magazines, except those provided under a subscription contract.

g) Contracts relating to accommodation, goods transport, car rental, food and beverage supply, and leisure activities or recreation, to be performed on a specific date or during a specific period.

ğ) Contracts relating to services performed instantly electronically or intangible goods delivered instantly to the Buyer.

h) Contracts relating to services that have begun to be performed with the Buyer's consent before the expiration of the withdrawal period.

Cosmetics and personal care products, underwear, swimwear, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery supplies (toner, cartridges, ribbons, etc.) must be unopened, untried, undamaged, and unused in order to be returnable.

10. RESOLUTION OF DISPUTES

The Buyer shall submit any complaints regarding the goods and services purchased to the Seller. The Buyer may file a complaint against the Seller (depending on the values ​​declared by the Ministry of Trade) with the Provincial or District Consumer Arbitration Board or the Consumer Court in the place where the product was purchased or where the Buyer resides.

11. OTHER PROVISIONS

After this Preliminary Information Form is read and accepted by the Buyer electronically, the Distance Sales Agreement will be established. By signing the Distance Sales Agreement, the Buyer acknowledges, undertakes, and declares that they accept the terms of this Preliminary Information Form.
